Ta\u015feron \u015firket elemanlar\u0131n\u0131n yeni ad\u0131 bundan b\u00f6yle &#8220;kamu \u00e7al\u0131\u015fan\u0131&#8221; olacak. Bu arkada\u015flar\u0131m\u0131z &#8220;\u00f6zel stat\u00fcl\u00fc s\u00f6zle\u015fmeli personel&#8221; olarak 657 say\u0131l\u0131 yasada 4E&#8217;li olarak kadroya ge\u00e7ecek. Bu \u00e7al\u0131\u015fanlar 657 say\u0131l\u0131 yasada olacaklar\u0131 i\u00e7in emeklilik hesaplamalar\u0131 da 4C yani eski ad\u0131yla Emekli Sand\u0131\u011f\u0131 kapsam\u0131nda de\u011ferlendirilecek.<\/p>\n<p><strong>G\u00dcVENL\u0130K SORU\u015eTURMASI<\/strong><\/p>\n<p>Yap\u0131lacak s\u00f6zle\u015fmeler 3&#8217;er y\u0131ll\u0131k olacak. S\u00f6zle\u015fme yenilenmesinde performans kriteri \u00f6ncelikli olarak d\u00fc\u015f\u00fcn\u00fclecek. G\u00fcvenlik ve ar\u015fiv taramalar\u0131 mutlaka yap\u0131lacak. G\u00fcvenlik ve ar\u015fiv ara\u015ft\u0131rmas\u0131 olumlu olmayan personel d\u00fczenlemeden yararlanamayacak. G\u00fcvenlik ara\u015ft\u0131rmas\u0131nda ba\u015fta FET\u00d6 olmak \u00fczere t\u00fcm ter\u00f6r \u00f6rg\u00fctleriyle irtibatl\u0131 olup olmad\u0131klar\u0131na bak\u0131lacak.<\/p>\n<p>Ara\u015ft\u0131rma s\u0131ras\u0131nda 657 say\u0131l\u0131 kanunun 48&#8217;inci maddesinde yer alan su\u00e7lar\u0131n olup olmad\u0131\u011f\u0131na da bak\u0131lacak. Yani devletin g\u00fcvenli\u011fine kar\u015f\u0131 su\u00e7lar, anayasal d\u00fczene kar\u015f\u0131 su\u00e7lar, zimmet, irtikap, r\u00fc\u015fvet, h\u0131rs\u0131zl\u0131k, doland\u0131r\u0131c\u0131l\u0131k, sahtecilik, g\u00fcveni k\u00f6t\u00fcye kullanma gibi su\u00e7lardan mahkum olmamak \u015fart\u0131 da aranacak.<a class=\"backLink\" href=\"https:\/\/www.ahaber.com.tr\/galeri\/yasam\/taseron-tarih-oluyor-kamu-calisani-geliyor\/5\">.<\/a><\/p>\n<p><strong>\u00dcCRETLER E\u015e\u0130TLENECEK<\/strong><\/p>\n<p>Personelle ayr\u0131ca m\u00fclakat da olacak. \u00dccretleri e\u011fer ayn\u0131 i\u015fi yapan personelden daha az ise aradaki fark zaman i\u00e7inde kapat\u0131lacak. Bu durumda baz\u0131 ta\u015feron \u00e7al\u0131\u015fanlar\u0131n maa\u015flar\u0131 y\u00fckselmi\u015f olacak. S\u00f6zle\u015fme i\u00e7in m\u00fcracaatlar \u00e7al\u0131\u015f\u0131lan kuruma yap\u0131lacak. Ba\u015fka bir kuruma ge\u00e7i\u015f yap\u0131lacaksa ihtiyaca g\u00f6re ve s\u0131nav ile yap\u0131labilecek. S\u00f6zle\u015fme i\u00e7in konulan 65 ya\u015f s\u0131n\u0131r\u0131 ise korunuyor. 65 ya\u015f\u0131n \u00fczerinde olan personel d\u00fczenlemeden yararlanamayacak.<\/p>\n<p><strong>\u00d6NCEL\u0130KLE 410 B\u0130N K\u0130\u015e\u0130<\/strong><\/p>\n<p>\u015eu anda kamuda \u00e7al\u0131\u015fan 817 bin ta\u015feron \u00e7al\u0131\u015fan\u0131n \u00f6ncelikle 410 bin ki\u015fi kapsam dahilinde olacak. Belediyeler ve K\u0130T&#8217;ler ilk etapta bu sistemde olmayacak. Ancak oralarda \u00e7al\u0131\u015fanlar i\u00e7in de maliyet hesaplar\u0131 yap\u0131l\u0131yor. D\u00fczenlemenin son \u015feklinde bu arkada\u015flar\u0131m\u0131z i\u00e7inde bir form\u00fcl a\u00e7\u0131klanabilir.<\/p>\n<p><strong>SEND\u0130KA HAKKI VE MAA\u015eA GARANT\u0130<\/strong><\/p>\n<p>\u00c7al\u0131\u015fanlar memur sendikalar\u0131na \u00fcye olabilecekler. \u015eirketler aradan \u00e7\u0131kaca\u011f\u0131 i\u00e7in de maa\u015f, k\u0131dem tazminat\u0131 ve emeklilik haklar\u0131na garanti gelecek. Bu arada kadro \u00e7ak\u0131l\u0131 olacak.<\/p>\n<p><strong>ASIL \u0130\u015e\u0130 YAPANA KADEMEL\u0130 GE\u00c7\u0130\u015e<\/strong><\/p>\n<p>As\u0131l i\u015fi yapan personelin kademeli olarak 4E&#8217;den 4A kadrosuna ge\u00e7i\u015fi de \u00fczerinde \u00e7al\u0131\u015f\u0131lan konular aras\u0131nda. \u0130mza yetkisini kullanan ve as\u0131l i\u015fi yapan personelin bu \u015fekilde de\u011ferlendirilmesi s\u00f6z konusu olacak.<\/p>\n<p><strong>\u0130HALELERE FORM\u00dcL<\/strong><\/p>\n<p>Yasan\u0131n \u00e7\u0131kmas\u0131n\u0131n ard\u0131ndan 2 ay i\u00e7inde t\u00fcm g\u00fcvenlik soru\u015fturmalar\u0131n\u0131n tamamlanmas\u0131 planlan\u0131yor. Bu s\u00fcre i\u00e7inde arac\u0131 \u015firketlerle olan anla\u015fmalar da feshedilecek ve \u00e7al\u0131\u015fanlar\u0131n patronu art\u0131k devlet olacak. \u0130hale s\u00f6zle\u015fmelerindeki tazminat maddeleri de yerine getirilecek.<\/p>\n<p><strong>TAR\u0130H TARTI\u015eILIYOR<\/strong><\/p>\n<p>Sisteme hangi tarihte i\u015fe ba\u015flayanlarla ilgili ise hen\u00fcz kesin karar verilmedi. Bu konuda birka\u00e7 tarih ile ilgili \u00e7al\u0131\u015fma s\u00fcr\u00fcyor. \u00d6ncelikle olarak daha \u00f6nce yaz\u0131lan taslaktaki 1 Kas\u0131m 2015 tarihi d\u00fc\u015f\u00fcn\u00fcl\u00fcyor. Yani bu tarihten \u00f6nce i\u015fe girenler sisteme al\u0131nacak. \u0130kinci d\u00fc\u015f\u00fcnce ise 31 Aral\u0131k 2017. \u00dc\u00e7\u00fcnc\u00fc planda ise yasan\u0131n y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten \u00f6nce i\u015fe girenler var.<\/p>\n<p><strong>DAVALAR B\u0130TECEK<\/strong><\/p>\n<p>Kadroya ge\u00e7ecek olan personelin ge\u00e7mi\u015fte kamuya kar\u015f\u0131 a\u00e7t\u0131\u011f\u0131 t\u00fcm davalardan da feragat etmesi gerekecek. B\u00f6ylece personel kamu ile daval\u0131k olmadan kadroya ge\u00e7mi\u015f olacak.
